This Privacy Policy explains how Xcel Payments, LLC d/b/a Xcel Companies (“Xcel Companies,” “Xcel,” “we,” “our,” or “us”) collects, uses, discloses, and safeguards personal information when you visit www.XcelCompanies.com and any related pages we own or operate (the “Site” or “Sites”), and when you interact with our services made available through the Sites (collectively, the “Services”). It also describes your choices and rights regarding your information and how to contact us.

If we deny your request, you may submit an appeal by replying to our decision email with “Appeal” in the subject line.
Opt out of sale, sharing, or targeted advertising
If our activities constitute a sale or sharing of personal information or targeted advertising under applicable state laws, you may opt out by:

12) Dispute Resolution

Arbitration agreement. To the extent permitted by law, any dispute, claim, or controversy arising out of or relating to this Privacy Policy or the Sites shall be resolved by confidential, binding arbitration on an individual basis. The arbitration will be conducted by the American Arbitration Association under its applicable rules. The arbitration will take place in Denver, Colorado, unless the parties agree otherwise, and Colorado law will apply to the extent not preempted by federal law. The arbitrator’s decision will be final and enforceable in any court of competent jurisdiction.
Class action waiver. Disputes will be resolved only on an individual basis. You and Xcel Companies agree that neither will bring claims as a plaintiff or class member in any purported class, consolidated, or representative action.
Limitations period. Any claim must be filed within one year after the claim arises or be permanently barred, unless a longer period is required by law.
13) Changes to This Privacy Policy
We may update this Privacy Policy from time to time. We will change the “Effective date” above when we do. Your continued use of the Sites after an update means you accept the revised Policy.
